Throughout these terms, “we”, “us”, and “our” refer to Jessica Vogt EI / Talpa & Co. By purchasing or booking services through this website or by direct agreement, you accept these Terms.

2. Our Services

Talpa & Co. provides professional coaching services, including:

  • Individual coaching sessions

  • Coaching programs

  • Group coaching or supervision spaces

  • Workshops and trainings

  • Digital resources related to coaching

Coaching is a collaborative process designed to support reflection, clarity, and personal or professional development. Coaching is not therapy, counseling, medical treatment, or psychological diagnosis.

3. How Services Can Be Purchased

Services may be purchased in two ways:

  • Direct purchase on the website using the available payment system.

  • Booking a call first: You may book a discovery or clarity call before purchasing. If we agree to work together, payment will be arranged afterward via invoice or payment link.

A contract is formed once:

  • Payment is completed through the website, or

  • We confirm the coaching agreement by email and payment is arranged.

4. Prices

Prices are listed on the website or communicated directly before purchase. All prices are in Euro (€) unless otherwise stated. Prices may change in the future but will not affect services already purchased.

5. Payment

Payment may be required:

  • In full before services begin, or

  • Through an agreed payment plan.

Payments are made via secure online systems (e.g., Stripe). If using a payment plan, you remain responsible for all scheduled payments. Failure to complete payments may result in suspension of services.

6. Scheduling

Sessions are scheduled at mutually agreed times and may take place:

  • Online (video call)

  • In group format

  • Through other agreed digital formats.

7. Rescheduling and Cancellations

  • Rescheduling: Requires at least 24 hours’ notice. Less notice may result in the session being marked as used.

  • Cancellation by the client: Completed sessions and packages are non-refundable once the first session has taken place.

8. Cooling-off Period (EU Consumer Rights)

If you purchase coaching services online as a consumer, you have 14 days to cancel without providing a reason. If services begin during this period, you acknowledge that delivered services may be charged proportionally.

9. Client Responsibility

Coaching is collaborative. You are responsible for your decisions, actions, and how you apply insights. We do not guarantee specific outcomes.

10. Confidentiality

Everything shared during sessions is confidential, except where disclosure is required by law or there is a risk of serious harm. Group participants must respect others’ confidentiality.

11. Intellectual Property

All materials provided by Talpa & Co. (e.g., worksheets, recordings, frameworks) remain our intellectual property. They are for personal use only and may not be reproduced or shared without permission.

12. Limitation of Liability

We provide services with professional care but do not replace medical, psychological, legal, or financial advice. To the extent permitted by law, Talpa & Co. is not liable for indirect losses (e.g., loss of income or opportunity) resulting from coaching decisions.

13. Changes to These Terms

These Terms may be updated occasionally. The version in place at the time of purchase applies to you.

14. Governing Law

These Terms are governed by French law. Disputes will fall under the jurisdiction of French courts.

15. Data Protection and Privacy

We protect your personal data in accordance with GDPR. Data is used only for service delivery and will not be shared without consent, except as required by law. You may request access, correction, or deletion of your data. For details, see our Privacy Policy.

16. Termination by Talpa & Co.

We may terminate the coaching relationship immediately if:

  • You breach these Terms,

  • You engage in disrespectful or harmful behavior,

  • Payment is not received as agreed.

Outstanding payments for rendered services remain due.

17. Refund Policy for Digital Resources

Digital resources are non-refundable once downloaded or accessed.

18. Group Coaching Code of Conduct

Participants agree to:

  • Treat others with respect and confidentiality,

  • Avoid discriminatory or disruptive behavior,

  • Not solicit or self-promote without approval.

We reserve the right to remove violators without refund.

19. Recording of Sessions

Sessions may be recorded for quality assurance with your consent. Recordings are stored securely and deleted after 12 months. You may opt out at any time.

20. Force Majeure

If services are disrupted by events beyond our control (e.g., pandemics, strikes), we will reschedule. If rescheduling is impossible, refunds will be issued proportionally for undelivered services.

21. Testimonials and Marketing

We may request testimonials. By providing one, you grant permission to use it in marketing unless you specify otherwise.

22. Dispute Resolution

Disputes will first be addressed through negotiation. If unresolved, mediation or arbitration may be pursued before litigation in Lyon, France.

23. Amendments to Services

We may modify services, pricing, or policies. Clients will be notified of significant changes in advance where reasonably possible. Continued use constitutes acceptance of new terms.

24. Health and Well-being Disclaimer

Coaching is not a substitute for medical or psychological care. If you have mental health concerns, consult a licensed provider. You acknowledge you are capable of participating in coaching.

25. Third-Party Links and Resources

Our services may include third-party tools (e.g., Zoom, Stripe). We are not responsible for their content or practices. Use at your own discretion.

26. Language and Communication

All services are conducted in French and English. Translation is your responsibility; we cannot guarantee accuracy.

27. Assignment of Rights

You may not transfer your rights or obligations under this agreement without our written consent.

28. Severability

If any provision is unenforceable, the rest remains in effect.

29. Entire Agreement

These Terms, along with attached policies, constitute the entire agreement and supersede all prior agreements.
